How Do I Get Started?
When you are ready to get started with your pro se No Fault divorce in New York State at We the People, you may make an appointment or come into our office. We will have you fill out a set of our New York State No Fault divorce workbooks..
Most of our divorcing couples find it takes anywhere from 15 to 30 minutes to fill out the necessary information in our workbooks. The questions we ask are simple and straightforward and the workbooks are easy to fill out. And if you have questions, you can always call us, e-mail us or stop on in to our office. We're here to help.
For all New York State uncontested divorce documents prepared at We the People, we will need simple information such as:
• Both parties’ names, addresses**, dates of birth, Social Security numbers
• Whether the parties have marital assets and/or debts.
If you and your spouse have minor children of your marriage, you can address the issues of custody, visitation and child support in the paperwork. Therefore, you will need to bring in some additional information including:
• Any Family Court Orders for Custody, Visitation and Child Support
• Income information for both spouses if there is not a Child Support Order from Family Court
• Health Insurance Information for the minor child/children
• Names, dates of birth and Social Security numbers for all minor children of the marriage
If you and your spouse have marital assets and/or debts to be addressed in your divorce documents, you may need to provide the following information:
• Information regarding any pension/retirement or 401K accounts to be divided
• Information on any jointly owned real estate and mortgages including balances and partial account numbers
• Balances and partial account numbers for any jointly held debts
Our fee of $499 is the only fee that is due up front when you are ready to get started in our office filling out our workbooks for your New York State No Fault or Uncontested Divorce.

**What to do if you want to get divorced but cannot find your spouse: There is a way to get divorced in New York State even if you cannot find your spouse; however, it is not something we can assist you with at We the People.

How does the "one signature" divorce work at We The People?
We would like to provide our customers with some information about the "one signature divorce" process at We The People.
Sometimes customers spouses might not be willing to sign the divorce papers, and in this situation, our customers may opt to have their spouses process served....so here's how we handle it at We The People.
After the index number is issued by the court, we will let our customer know that we've prepared an Affidavit of Service Form. There is no additional fee for this form, it's included in our basic economical price.
Now our customer can use any process server they like for the serving of their spouse, or our office can recommend an independent, reputable, licensed process serving company. Process Server charges can range anywhere from approximately $75. to $125. depending on the situation.
Once the spouse is served by the process server, the process server simply completes the Affidavit of Service Form.
If the spouse does not respond after being served, our customer simply signs the remaining divorce documents and the divorce documents get filed at court with one signature, our customers.
However, if your spouse does respond & retains an attorney and/or contests, then We The People cannot continue handling your forms. But don't worry, we will provide you with all of the forms prepared up to that point so the fee you paid us is never wasted.
